Capitalized terms used but not defined in this document shall have the meanings assigned to them in the
TutorCloud
Definitions & Glossary.
Key terms used in these Terms include:
- “TutorCloud”: The AI-based tutoring platform and services.
- “User”: Any person accessing or using the Services.
- “Student”: A learner using the Services, whether school-linked or independent.
- “Parent”: A legal guardian providing consent or managing a student account.
- “Teacher”: An educator or facilitator authorized to use the Services.
- “School” / “District”: Educational institutions contracting for Services.
- “Content”: Materials uploaded, generated, or displayed on the platform.
- “AI Systems”: Automated systems used to provide learning recommendations.
By accessing or using the TutorCloud platform, you agree to be bound by these Terms of Service and all applicable policies referenced herein.
Depending on the manner in which you access or use TutorCloud (including, without limitation, as a Student, Parent or Legal Guardian, Teacher, Partner, or institutional user), additional role-specific terms, agreements, or disclosures may apply. Where applicable, such role-specific documents apply in addition to these Terms of Service and govern your use of the platform in that role.
If you do not agree to these Terms, you must not access or use the TutorCloud platform.

- Users must provide accurate and complete registration information.
- Students under the applicable age of consent may use the Services only with:
- School or district authorization, or
- Parental or guardian consent, as required by law.
- Accounts are non-transferable.
TutorCloud may suspend or terminate accounts that violate these Terms.

Access and functionality depend on user role:
- Students access learning features
- Parents access oversight features
- Teachers access facilitation, review, and oversight tools
- Schools and districts access administrative controls
Users must not access features outside their assigned role.

TutorCloud is provided for educational and tutoring purposes only.
The Services are not intended to:
- Replace formal school instruction
- Provide professional certification
- Serve as sole decision-makers for academic outcomes
[Transparency | Automated Processing Safeguards]
TutorCloud uses AI to generate instructional content units during learning sessions and to support learning
recommendations.
- AI outputs are advisory only.
- Final educational decisions remain with humans.
- AI use is governed by the AI Usage and Recommendation Disclosure, which forms part of these Terms.
AI systems are deployed and governed within TutorCloud’s internal AI risk management and oversight framework.

Users may upload content where permitted.
By uploading content, users:
- Confirm they have the right to use and share it
- Grant TutorCloud a limited, non-exclusive license to store and display it for educational purposes
TutorCloud does not claim ownership of user-uploaded content.

Personal and student data is handled in accordance with:
- The TutorCloud Privacy Policy
- The Children’s and Student Privacy Notice
- Applicable school or district agreements
For school-linked students, TutorCloud acts on documented institutional instructions.

Users must comply with:
- Acceptable Use Policy
- Community Guidelines / Code of Conduct
Violations may result in suspension or termination.
[Reasonableness Standard]
TutorCloud may:
- Modify features
- Update content
- Improve AI systems
- Perform maintenance
We aim to provide reliable access but do not guarantee uninterrupted service.
[Vendor Accountability | Data Safeguards]
TutorCloud may integrate with third-party services.
- Third-party services are subject to their own terms.
- TutorCloud is not responsible for third-party services outside its control.
[Fair Process | Accountability]
TutorCloud may suspend or terminate access:
- For violations of these Terms
- To protect students or platform integrity
- Where required by law or institutional request
Where applicable, notice will be provided.
[Consumer Law | Educational Integrity]
The Services are provided “as is” and “as available”.
TutorCloud does not guarantee:
- Specific academic outcomes
- Error-free operation
- Suitability for all learning needs
[Contractual Limitation Principles]
To the maximum extent permitted by law:
- TutorCloud is not liable for indirect or consequential damages
- Liability is limited to fees paid, where applicable
Some jurisdictions do not allow certain limitations.
[Risk Allocation Principle]
Users agree to indemnify TutorCloud against claims arising from:
- Misuse of the Services
- Violation of these Terms
- Infringement of third-party rights
[Jurisdictional Flexibility]
Governing law and dispute resolution mechanisms may:
- Be specified in regional addenda
- Be defined in school or district agreements
Absent such specification, applicable local laws apply.

Material changes will be communicated as required by law.
